1) Agreement to terms
By creating an account or using YƐNKO, you agree to these Terms and all policies referenced here (Privacy Policy, Cookie Policy) which form part of this agreement.
2) Eligibility
You must be at least 18 years old and legally able to enter contracts. Drivers must also meet all licensing, insurance, and vehicle requirements set by us and local law.
3) Accounts and security
- Keep your login details confidential; you are responsible for all activity under your account.
- Provide accurate, up-to-date information; update promptly if details change.
- We may suspend or terminate accounts for policy violations, fraud, or unsafe behavior.
4) Booking and platform rules
- Passengers may request rides only for lawful purposes and must pay confirmed fares.
- Drivers choose to accept or reject rides and must complete accepted rides diligently and safely.
- We may adjust or cancel trips for safety, fraud prevention, or operational reasons.
5) Pricing, fees, and payments
- Fares are shown before you confirm a ride and may reflect distance, time, demand, and taxes.
- Platform service fees and driver earnings are calculated per trip; drivers can view details in their dashboard.
- Cash and Mobile Money are supported. You authorize any applicable adjustments (e.g., tolls, cleaning fees for damage).
6) Cancellations and no-shows
- Passengers may cancel before pickup; late cancellations or no-shows may incur a fee.
- Drivers who cancel after accepting may face penalties or temporary suspension.
- We may waive or apply fees at our discretion based on trip context and policy.
7) Safety and conduct
- All users must follow local laws, respect others, and avoid harassment, discrimination, or unsafe behavior.
- Drivers must maintain valid licenses, insurance, roadworthy vehicles, and comply with our vetting requirements.
- Emergency features and support channels must not be misused.
8) Content and communications
You may receive service messages (trip status, security alerts) via app, email, or SMS. Marketing communications are optional and can be opted out as described in the Privacy Policy.
9) Intellectual property
The YƐNKO platform, branding, and content are owned by us or our licensors. You receive a limited, non-transferable right to use the services per these Terms.
10) Disclaimer
The services are provided “as is†to the fullest extent permitted by law. We do not guarantee uninterrupted availability or warrant third-party content or networks.
11) Limitation of liability
To the extent permitted by law, our total liability for claims related to the services is limited to the greater of (a) the amounts you paid for the ride giving rise to the claim, or (b) USD 100 (or equivalent). We are not liable for indirect or consequential damages.
12) Indemnity
You agree to indemnify YƐNKO against claims arising from your misuse of the services, violation of these Terms, or infringement of others’ rights.
13) Privacy and cookies
Your personal data is handled under our Privacy Policy. Our use of cookies and similar technologies is explained in the Cookie Policy.
14) Changes to these terms
We may update these Terms as the service evolves. Material changes will be notified via the app or email. Continued use after changes means you accept the updated Terms.
15) Governing law
These Terms are governed by the laws of Ghana, without regard to conflict-of-law principles. Disputes will be resolved in the courts located in Ghana unless local law requires otherwise.
